The petitioner is languishing in custody since 25.03.2017 in connection with Daniyawan P.S. Case No. 90 of 2015 for the offences instituted under Sections 302, 427/34 of the IPC. The prosecution story, in brief, is that on the alleged date and time of occurrence, two persons were killed by a Truck which the informant's nephew was driving and while fleeing away from the spot, a mob caught him and assaulted him brutally as a result of which, he died.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.03.2017. There is no allegation of tampering of the witnesses alleged against the petitioner. He has
Patna High Court Cr.Misc. No.22875 of 2017 (2) dt.22-05-2017 2/2 got no criminal antecedent. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner.
On behalf of the learned counsels for the informant and the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.
