ANJANA MISHRA ORAL ORDER 05-08-2015 Learned counsel for the petitioner submits that in the present application at paragraph no.3, Case number C.R. 690 of 2013 has been inadvertently typed instead of Complaint Case No. 291 of 2012. Learned counsel for the petitioner seeks permission to correct the same. Permission is, accordingly, granted. In the instant modification application, the petitioner has sought for extension of time for surrender granted vide order dated 16.4.2015 passed in Cr.Misc. No.43234 of 2014 since due to unavoidable circumstances, he could not surrender within the prescribed time limit and seeks further extension of six weeks. Considering the submissions made by the learned

Patna High Court Cr.Misc. No.28407 of 2015 (2) dt.05-08-2015 2/2 counsel for the petitioner and the grounds made out in the modification application, the time fixed for surrender in the said order dated 16.4.2015 is extended by six weeks from today. The order dated 16.04.2015 passed in Cr.Misc. No.43234 of 2014 shall stand modified to the above extent. It is made clear that if the petitioner does not surrender in the court below within the aforesaid period, the order dated 16.04.2015 passed in Cr.Misc. No.43234 of 2014 shall stand cancelled.

This application shall stand disposed of.
