====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-02-2021 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Sabour P.S. Case No. 16 of 2020 dated 16.01.2020 instituted for the offences under Sections 341, 323, 504, 506, 307, 379/34 of the Indian Penal Code. For the informant having asked for Rs. 20/- from his cousin which was refused, an occurrence took place in which the father and brother of the informant were assaulted by six named accused persons of this case. The informant is also stated to have been assaulted. Ultimately the father of the informant succumbed to the injuries.

The petitioner has not been named in the FIR but in the further statement, the informant has alleged

Patna High Court CR. MISC. No.37047 of 2020(2) dt.02-02-2021 2/2 that by mistake, he omitted to name the petitioner also who is his nephew. One of the accused persons of this case viz. Santosh Tanti has been granted bail by a Bench of this Court.

The petitioner is in custody since 18.01.2020. Regard being had to the nature of accusation against the petitioner and his period of custody as also taking into account his clean antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 16 of 2020.
