JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 29-11-2016 Heard the counsel for the petitioner and the State. The petitioner prays for grant of bail in Beur P.S. Case No. 128 of 2016 registered under diverse penal provisions of the Arms Act.
The ASI of Police lodged the case that on a search one country-made pistol and 02 live cartridges were recovered from the possession of the petitioner.
It is stated that the petitioner is in judicial custody since 28.05.2016. In one of the cited cases in paragraph 3 he has been acquitted. On the alleged confession of the petitioner he has also been named accused in another case.
Be that as it may, considering the period of incarceration and other materials reflected from the records, I am persuade to
Patna High Court Cr.Misc. No.47975 of 2016 (2) dt.29-11-2016 2/2 grant bail to the petitioner. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Smt. Savita Rani Judicial Magistrate, 1st Class, Patna in Beur P.S. Case No. 128 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
