1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 70(2), 351(2), 352 of B.N.S. & Section 4/6 of POCSO Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner along with Shyam Babu on 12.09.2024 at 12 in the midnight came to the house of the informant via terrace and acted inappropriately with his minor daughter, aged about 14 years, further Shyam Babu caught the victim and petitioner committed wrong with her, it is next alleged that

No.42039 of 2025(2) dt.09-07-2025 2/3 victim came down the stairs and disclosed about the occurrence, accordingly, the informant went to the house of the accused persons where he was abused and threatened not to institute a case. It is alleged that earlier also the accused persons committed wrong with the victim and had threatened not to institute a case.
4. The learned counsel for the petitioner submits that Shyam Babu Ram had approached this court seeking anticipatory bail by filing Cr. Misc. 14586/2025 and the same was allowed by an order dated 02.04.2025 after considering the case on merit. It is further submitted that case of the petitioner is also similar to that of Shyam Babu Ram though petitioner is alleged to have committed wrong but then the injury report of the victim does not corroborate the allegation. It is also submitted that petitioner will not abscond rather will co-operate in the investigation.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner and also taking into consideration the order dated 02.04.2025 in Cr. Misc. No.14586/2025, the petitioner above-named, in the event of his arrest or surrender
Patna High Court CR. MISC. No.42039 of 2025(2) dt.09-07-2025 3/3 before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Barhara P.S. Case No.268/2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
7. One of the bailors of the petitioner shall be his father, namely, Vijnand Ram @ Bijnandan Ram.
8. However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioner despite giving assurance to this court is not co-operating in the investigation in that event the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
9. Let a copy of this order be sent to the concerned P.S. through the learned trial court.
