JUSTICE RAKESH KUMAR ORAL ORDER 11-08-2016 In this case, earlier by order dated 20.07.2016 the Vigilance Investigation Bureau through its Superintendent of Police, Bihar, Patna was permitted to be added as Respondent no.12 and the learned counsel for the petitioner was directed to serve copy of entire brief on learned Senior Law Officer for the Vigilance Investigation Bureau.

Patna High Court CWJC No.5496 of 2011 (16) dt.11-08-2016 2/2 of the Vigilance Investigation Bureau submits that in view of earlier order, he had collected the copy of the entire brief and briefly an enquiry was conducted. Prima facie, he suggests that some irregularity has been committed in the entire selection process.

I have perused the materials on record.

In view of facts and circumstances, instead of keeping the writ petition pending, the Court proposes to dispose of the writ petition with observation that if in enquiry the materials are collected , which suggests commission of cognizable offence, the Superintendent of Police, Vigilance Investigation Bureau is required to immediately register a regular case, investigate the same and take steps for early conclusion of the investigation. The writ petition stands disposed of.

This order was passed in presence of learned counsel for the petitioner, learned AC to AAG-3 as well as Sri Ramakant Sharma, learned Senior Law Officer of the Vigilance Department.
