JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 25(1-b)a 26, 35 of the Arms Act and Section 47(A) of the Excise Act.
One rifle, two country made pistols and bottles of liquor were recovered from the house of the petitioner but according to the prosecution case itself, no one was present in the house of the petitioner at the time of alleged recovery. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 22.3.2016.
Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten
Patna High Court Cr.Misc. No.36296 of 2016 (2) dt.23-08-2016 2/2 thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Samastipur in connection with Patori P.S. Case No.71 of 2016.
