The petitioner seeks bail in Narcotic Drugs and Psychotropic Substances (for brevity, NDPS) Act Case No 6 of 2015 arising out of Chand Police Station (for brevity PS) Case No 17 of 2012 dated 11.04.2012 instituted for the offence punishable under Sections 20 (b), 21, 25 of NDPS Act, 1985. The prosecution case alleges 19.500 Kgs Ganja to be recovered from the petitioner's house.

Learned counsel submits that the recovery is in violation of the mandatory procedure and that the petitioner has falsely been implicated in this case. He is in custody since 10.12.2019.

Patna High Court CR. MISC. No.37246 of 2020(3) dt.23-02-2021 2/2 Learned APP for the State has opposed the prayer for bail referring to Section 37 of NDPS Act.

Having regard to the submissions advanced by the parties, this Court is not inclined to grant bail to the petitioner. Prayer for bail is rejected with expectation that trial Court should proceed with the trial expeditiously and without any undue delay.
