Petitioner seeks bail in a case registered under sections 302, 328/34 of the Indian Penal Code.
Petitioner happens to be husband of the deceased and admittedly, deceased died in other than normal condition. However, prior to registration of the present case, fardbeyan of the informant was recorded by the police on 16.4.2015 in which she accepted that her daughter was leading her married life happily and peacefully with the petitioner. Subsequently, she filed complaint case on 6.5.2015 which was sent to the concerned police station for registration of the FIR and thereafter, present case was lodged.
In course of investigation of the present case, some witnesses stated that petitioner had affair with a woman and that was the reason, deceased committed suicide. However, police, after due investigation, submitted charge sheet for the offence punishable under
Patna High Court Cr.Misc. No.42336 of 2016 (6) dt.19-12-2016 section 306 of the Indian Penal Code.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Runni Saidpur P.S.
