JUSTICE ARUN KUMAR ORAL ORDER 20-07-2018 Heard learned Counsel for the petitioners and the State as also the learned Counsel appearing on behalf of the informant. Petitioners, already in custody since 14.4.2018, seeks bail in Kanhauli PS Case No. 26 of 2018 registered under Sections 341, 323, 376, 511/34 of the IPC and Sections 8/10 of Pocso Act. The allegation in brief is that in the evening four persons entered into the house of the prosecutrix while her elder brother and brother-in-law were taking breakfast and these petitioners made attempt to rape her, when alarm was raised they escaped away. Learned Counsel for the petitioners submits that the petitioners have been falsely implicated in this case because they were witness in the case instituted by one Yogi Pandit one of the agnate of the informant's side, the petitioners are co-villages and have no criminal antecedent.
Whereas learned Counsel appearing on behalf of the informant opposed the prayer for bail and submits that the petitioners are not witnesses in charge-sheet.
Having considered the said facts and circumstances, the
Patna High Court Cr.Misc. No.29912 of 2018 (7) dt.20-07-2018 petitioners, namely, Ajay Rai @ Panga and Manoj Mahto @ Manoj Kumar are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge lst -cum Special Judge (Pocso Act), Sitamarhi in connection with Kanhauli PS Case No. 26 of 2018.
