Present:- Member(Judicial) :Mr. Justice Ahsanuddin Amanullah Member(Legal Profession) : Mr. Binod Bihari Sinha, Advocate AWARD The dispute between the parties having been referred for determination to the Lok Adalat and the parties having compromised/ settled the case/matter, the following award is passed in terms of the settlement: As agreed between the parties, the writ petition stands disposed off in the following terms.

Learned counsel for the State agrees that if the petitioner files a detailed representation with regard to condoning the shortfall in the length of service making him eligible for pension, the same shall be considered in accordance with law and taking into consideration the various judicial pronouncements in this regard.

Learned counsel for the petitioner agrees to file such a representation within three weeks from today before the competent authority. Upon the same being filed, it shall be considered after giving opportunity of personal hearing to the petitioner and a reasoned order shall be passed within three weeks thereafter. If any payment is to be made, the same shall be paid within the next two weeks. However, in the event, an adverse order is passed, the petitioner shall be at liberty to challenge the same in accordance with law before the appropriate forum.

The parties are informed that the court fee, if any, paid by any of them shall be refunded.
