Having considered the reasons stated in I.A. No.1 of 2021, the limitation petition is allowed. The limitation is condoned.

The appellant is convicted under Section 304B/34 of the Indian Penal Code.

It is submitted that appellant surrendered in the court below on 28.05.2013 and he was granted bail by this Court on 23.01.2019 in Cr. Misc. No.65727 of 2018. Thereafter the appellant was convicted on 20.01.2020 and since then he is in jail. The appellant has remained in jail for more than five years and seven months during the course of trial and one year and four months after his conviction.

Taking into consideration the facts aforesaid, during the pendency of the appeal, the sentence of the appellant is suspended and let the appellant, above named be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge III, Supaul in connection with S.T. No.02/2014, arising out of Kishanpur P.S. Case No.172 of 2011.

List this case on 26.07.2021 awaiting the Lower Court record.
