Petitioner apprehends his arrest in a case registered under sections 498A, 494 of the Indian Penal Code. It is alleged by the complainant Manju Devi that she was married with the petitioner and after marriage she had gone to her Sasural with gifted article but the accused persons started to demand one Hero Honda Motorcycle and Rs. 50000/- and due to non-fulfillment of demand she was tortured and ousted from her matrimonial house.
Learned counsel for the petitioner and the informant submitted that both are agree to live together as
Patna High Court Cr.Misc. No.29541 of 2015 (2) dt.28-07-2015 2/2 husband and wife.
Considering the aforesaid submission, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M. Araria in Complaint Case No. 3378 ( C ) of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
It is directed that both the parties shall appear before the court below on the date fixed and the court below shall ensure that both the parties live together and if the petitioner decline to take the informant along with him then he shall deposit Rs. 2000/- per month in the court below which shall be released in favour of the complainant/informant.
