JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 504 and 302 of the I.P.C.

The allegation is that the accused persons including the petitioner assaulted the husband of the informant and others, as a result of which the husband of the informant sustained injury at the head and in course of treatment he died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.10.2016 and the charge sheet has been submitted in the present case. Petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus

Patna High Court Cr.Misc. No.23283 of 2017 (2) dt.23-05-2017 2/2 allegation has been made against eleven accused named in the F.I.R. Petitioner is also one of them. No specific injury has been attributed against the petitioner. Other co-accused has been granted bail vide Annexure-2 to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge III, Madhepura in connection with Srinagar P.S. case No.39 of 2016 (Sessions Trial No.13 of 2017).
