The petitioner apprehends his arrest in a case under Section 7 of the E.C. Act.
The Block Development Officer, Madhuban intercepted a truck bearing registration no. BR 06G 4325, from which 200 bags of wheat were recovered. Another truck bearing registration no. BR 05GA 3170 was also seized from which 73 bags of wheat were recovered. The driver Serajuddin disclosed that at the instance of Vijay Gupta, manager of Madhuban Godown, they were carrying wheat to the house of Sanjay Modi, the petitioner. Except the disclosure made by Serajuddin, there is absolutely no evidence to show that the petitioner purchased the foodgrains in order to sell the same in the black-market. Patna High Court Cr.Misc. No.30506 of 2015 (2) dt.28-07-2015 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sikarahana at Motihari, East Champaran in Madhuban P.S. Case No. 103/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
