The petitioner seeks bail in Maker P.S. Case No.50 of 2016 instituted for the offences under Sections 386, 387, 399, 402, 120B of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of the Arms Act, Sections 4/5 of the explosive Substance Act and Sections 16(1)B, 17, 18, 18 A, 19, 20, 38, 39 and 40 of the U.A.P. Act.
On the information two sides of police party, one from Muzaffarpur and another from Saran raided the place where 15-20 persons assembled and from their joint possession explosive substance and fire arms were recovered for the purposes of creation of destruction. From the
Patna High Court Cr.Misc. No.43350 of 2016 (2) dt.06-10-2016 possession of the petitioner rifle has been recovered. Petitioner also carries one case over his head for similar nature.
Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the trial court is directed to expedite the trial.
