The petitioner seeks bail in Barachati P.S. Case No. 341 of 2016 registered under Sections 8, 20(kha), 11(ga), 22(ga), 25 and 29 of the N.D.P.S. Act.

The police got information that drug smugglers are coming on Honda City Car bearing Registration No. DL4CAB 7420. The police intercepted the vehicle and two persons sitting inside the car disclosed their name as Pintu Kumar (petitioner) and Chandra Shekhar Yadav. From the dickey of the vehicle, 155 Kg of ganja besides mobile and cash was recovered. Leanred counsel for the petitioner submits that the ganja was recovered from the dickey of the car. The petitioner was sitting inside the car. He has got no knowledge about the

Patna High Court Cr.Misc. No.22251 of 2017 (2) dt.17-05-2017 2/2 ganja kept in the dickey, but it appears that the informant got information that narcotic drugs are being brought by a car and on such inputs, the car was intercepted and huge quantity of ganja weighing 155 Kg was recovered.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Mishra/- U T
