JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.

In this application for anticipatory bail the petitioner apprehends her arrest for the offences punishable under sections 420, 406, 302 and 201/34 of the I.P.C.

Allegedly, father of the informant went to the house of Uttam Chaudhary for paying dues of Rs. 18,000/- and to get the land registered but he did not return and thereafter his dead body was found from the room existing under the court-yard. The petitioner and others are named in the FIR.

Submission is of false implication and that the petitioner is college going student and co-accused Uttam Chaudhary is confessing his guilt and has not stated name of the

Patna High Court Cr.Misc. No.42679 of 2014 (4) dt.16-04-2015 2/2 petitioner. In this case other co-accused Dharmshila Devi and Sheela Devi have been allowed regular bail by this Court. There is no specific allegation against the petitioner and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes.

Considering that in the house father of the informant was killed and his dead body was recovered from the room existing under the court-yard and as such this Court is not persuaded to grant privilege of pre-arrest bail to the petitioner and accordingly her such prayer stands rejected in connection with Agiaon (G) Garhani P.S. Case No. 62 of 2014 pending in the court of C.J.M. Ara, Bhojpur.
