JUSTICE SANJAY KUMAR ORAL ORDER 03-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner, who is in custody since 23.03.2018, seeks bail in connection with Katoria Police Station Case No. 331 of 2014 registered for an offence punishable under section 395 of the Indian Penal Code.

It has been submitted that neither the petitioner is named in the FIR nor any article has been recovered from his possession and house. His name transpired in the confessional statement of one Kunal Singh, who was allegedly apprehended by Police and except the disclosure of the name of this petitioner, there is nothing against him. The other coaccuseds have been allowed bail by different coordinate Bench of

Patna High Court Cr.Misc. No.30232 of 2018 (3) dt.03-07-2018 2/2 this Court in Cr. Misc. No. 17091 of 2015 and Cr. Misc. No. 4264 of 2016. The case of the petitioner stands of similar footing to the case of co-accuseds who are on bail and so he deserves bail.

Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Banka in connection with Katoria Police Station Case No. 331 of 2014, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
