Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of eight weeks.

The petitioner seeks bail in Neemchak Bathani P.S. case No.01 of 2016 registered under Sections 302/34 of the Indian Penal Code, pending in the court of A.C.J.M. Xth, Gaya. The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner is the assailant. It is pointed out on behalf of the petitioner that the petitioner is in custody since 12.02.2020.

A report was called for from the court below

Patna High Court CR. MISC. No.50256 of 2021(3) dt.22-12-2021 2/2 regarding the stage of trial. It has been reported that out of fourteen prosecution witnesses four prosecution witnesses have already been examined and the trial is expected to be concluded within a period of six months.

Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of a copy of this order. The District Magistrate, Gaya and the Superintendent of Police, Gaya are also directed to take necessary steps to produce the witnesses on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period. Let this order be communicated to the District Magistrate, Gaya and the Senior Superintendent of Police, Gaya.
