The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

It is a case of recovery of five liters of illicit liquor from the house of this petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that meagre quantity of illicit liquor has been recovered and petitioner has not been apprehended at the spot. Petitioner has clean antecedent.

Learned APP appearing for the State has opposed the

Patna High Court CR. MISC. No.41282 of 2022(2) dt.13-10-2022 2/2 prayer for anticipatory bail.

Considering the aforesaid submissions and the fact that meagre quantity of liquor has been recovered, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Ladaniya P.S. Case No. 56 of 2022/G.R. No. 347 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
