====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-07-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner, who is husband of the opposite party no. 2, apprehends his arrest in a case registered for the offence punishable under Section 304(B), 328 and 34 of the Indian Penal Code.

3. As per prosecution story, the informant alleges that the marriage of his sister was solemnized with the petitioner long back on 19.04.2018. However, she has always been subjected to demand of dowry and on account of non-fulfillment of the same she was done to death on 07.06.2024, after administering poison by all the accused persons.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this

Patna High Court CR. MISC. No.39438 of 2025(3) dt.09-07-2025 2/2 case merely because he happens to be husband of the deceased. Informant is not an eye-witness to the occurrence. Petitioner neither demanded any dowry nor committed any torture to the deceased. On the alleged date of occurrence, petitioner was in Delhi. As a matter of fact, sister of the informant committed suicide and died while being taken to hospital.

Learned counsel for the informant and the State vehemently opposes the prayer for bail of the petitioner and submits that the petitioner is the husband of the informant and there is direct and specific allegation that he along with other accused persons committed murder of the sister of the informant. Deceased died in an unnatural circumstances within six years of marriage at her matrimonial home.

6. Considering the nature and gravity of offence and the fact that petitioner is husband of the deceased and there is specific and direct allegation against him, prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Neha/- U T
