JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363/365/366/379/120B/34 of the Indian Penal Code. The prosecution case is that after ten years of marriage, the informant's wife found missing on 24.03.2013 when suspicion was raised against petitioner, co-accused Ranjeet Rai and Hari Kishan Prasad and Geeta Devi have abducted the wife of informant. In 164 Cr.P.C. statement, recorded after nine months of the occurrence, the wife of the informant alleged that the petitioner and others forcibly made her to sit in Bolero vehicle but she was actually kidnapped by co-accused Ranjeet Rai, who subsequently ravished her.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.30378 of 2015 (2) dt.31-07-2015 2/2 for the occurrence of 24.03.2013, the complaint was filed on 16.04.2013, which came to be registered as police case on 05.05.2013. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, the co-accused Geeta Devi and Ranjeet Rai have been granted anticipatory bail vide Criminal Miscellaneous Nos.22108 of 2014 and 4260 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hazipur in connection with Mahnar P.S. Case No.62 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
