JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-03-2022 Heard Mr. Vikram Deo Singh, learned counsel for the petitioner and Ms. Gulnar Begum, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Phulwari Sharif (Janipur) PS Case No. 509/2020 registered for the offence punishable under Section 395 of the IPC. Six unknown miscreants have, allegedly, looted the pickup van of the informant while he was going to Patna from Jharkhand carrying cucumbers.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of confessional statement recorded by the police in Phulwari Sharif PS case No. 534/2020 and except the confessional statement, no other material has come against the petitioner during course of

Patna High Court CR. MISC. No.50183 of 2021(2) dt.25-03-2022 2/2 investigation. He further submits that the pickup van has been recovered in an abandoned condition from Akuri Petrol Pump and it has not been recovered on the basis of confessional statement of the petitioner, petitioner is in custody since 06.11.2020 and the charge-sheet has been submitted. Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner has been made accused on the basis of confessional statement recorded by the police, charge-sheet has been submitted in the matter and petitioner is in custody since 06.11.2020, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, PARDESHI KUMAR be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Patna in connection with Phulwari Sharif (Janipur) PS Case No. 509/2020.
