JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending their arrest in a case instituted under Sections 498A of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. It is alleged by the complainant that the petitioner along with other accused persons named in the complaint petition tortured the complainant in various manner for non-fulfilment of dowry demand and ultimately they ousted her from her matrimonial house causing her to take shelter in her parent's house.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case.

Patna High Court Cr.Misc. No.28510 of 2015 (3) dt.01-10-2015 There is no chance of reconciliation between the parties. It is further submitted that petitioner is ready to deposit an amount of Rs.1,000/- per month in the court below which shall be released in favour of the complainant.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, it is directed that the petitioner shall deposit an amount of Rs.1,000/- per month in the court below which shall be released in favour of the complainant and on doing so, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Bhagalpur in connection with Complaint Case No.1178 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
