JUSTICE SUDHIR SINGH ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 364, 365 and 120B of the Indian Penal Code read with Sections 25 (1-b) A, 26 and 35 of the Arms Act. Allegation against petitioner is that he along with other accused persons had abducted daughter of informant and kept her confined in a room.
It has been submitted on behalf of petitioner that he is in custody since 22.9.2016. Chargesheet has been submitted against petitioner. He has falsely been implicated in the present case. No allegation of tampering of witnesses is alleged against petitioner. The victim has been examined under Section 164 of the Code of Criminal Procedure. She has not named this petitioner. The main allegation has been made against co-accused, namely, Prashant Kumar.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.53542 of 2016 (2) dt.22-12-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Samastipur, in connection with Khanpur P.S. Case no. 97 of 2016.
