2. The petitioner seeks regular bail in connection with Naugachia P.S. Case No. 38 of 2025 registered for the offence under Sections 317(5), 317(4), 3(5) of the Bhartiya Nyaya Sanhita.

3. As per the prosecution case, the petitioner is accused of committing theft.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He submits that co-accused, namely, Shyam Singh has been granted bail by a Co-ordinate Bench this Court vide order dated 25.06.2025 passed in Cr. Misc. No.39034 of 2025. The petitioner is in custody since 03.02.2025.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st Naugachia/concerned Court below in connection with Naugachia P.S. Case No. 38 of 2025 subject to condition that:- (i) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.

(ii) The petitioner will mark his attendance at the Naugachia Police Station on the every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.
