JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 14-12-2021 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Konch P.S. Case No. 24 of 2020, registered for the offences punishable under Sections 457, 382, 324, 326, 307 of the Indian Penal Code.

As per allegation, the informant lodged an FIR stating therein that the occurrence took place in the night as a thief entered into his house and was taking out some articles from a bag, meanwhile, his wife woke up and tried to apprehend that thief, he badly assaulted her with pasuli and when the informant went to rescue his wife, the petitioner inflicted pasuli blow on his head. The

Patna High Court CR. MISC. No.200 of 2021(3) dt.14-12-2021 2/2 name of that thief was also disclosed by the informant as Bindi Singh @ Birendra Singh @ Billi Singh, the present petitioner. Learned counsel for the petitioner has submitted that it has not been mentioned as to where from the petitioner entered into house of the informant and he has also submitted that there is no criminal antecedent of the petitioner.

Considering the above-mentioned facts and circumstances, let the petitioner be released on bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. III, Gaya in connection with Konch P.S. Case No. 24 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Learned counsel for the petitioner has filed the original copy of the petition as the available xerox copy of the petition is not legible.
