30-11-2021 Heard learned counsel for the parties.

The petitioners seek bail in Bikramganj P.S. Case No. 518 of 2020, registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per the prosecution case, on 30.12.2020 at about 11:00 AM, while the informant was coming to his house, on the way, these petitioners alongwith other two co-accused assaulted the informant by lathi, danda & iron rod, due to which, the informant sustained head injury. It is further alleged that accused also assaulted brother of informant by Rami and threatened with dire consequences, if any case is lodged by the informant side.

No.51986 of 2021(2) dt.30-11-2021 2/2 It is submitted on behalf of petitioners that there is general and omnibus allegation against the petitioners and no specific overt act has been alleged against any of the petitioners. Injury sustained by brother of informant is simple. Occurrence took place due to dispute between the parties over irrigation of field. They are in custody since 07.04.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioners is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist Bikramganj, District Rohtas in connection with Bikramganj P.S. Case No. 518 of 2020.
