2. The petitioners have prayed for bail in connection with Beur P.S. Case No.54 of 2025 registered for the offence punishable under Section 303(2) of B.N.S.
3. The case of the prosecution is that the reception ceremony of son of the informant Avinash Kumar was being celebrated at Utsav Hall, Tej Pratap Nagar, Beur, Patna. It is alleged that from there a bag containing cash and jewellery was missing. It is alleged that some unknown miscreants have
Patna High Court CR. MISC. No.39769 of 2025(4) dt.04-09-2025 2/3 committed this offence. All the occurrence is there in CCTV camera. During investigation, in CCTV camera only one boy of 11 years was found.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. It has further been submitted that petitioners were arrested in another case and from that case they were remanded in the present case. Nothing has been recovered from their possession. They have been framed in this case only on the basis of their antecedent. Petitioners are in judicial custody since 04.04.2025.
5. The application for bail is vehemently opposed by learned APP for the State and has submitted that petitioner no.1 is having criminal antecedent of 11 cases, petitioner no. 2 is having criminal antecedent of 6 cases and petitioner no.3 is having criminal antecedent of 9 cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned
