JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Section 136 of the Electricity Act and Section 379 of the of the Indian Penal Code.
The offence relates to a theft committed in Nawada Grid, of burnt and waste Coil. Allegedly, the petitioner is said to have accepted of having committed theft and he is also said to have deposited part of the articles allegedly stolen by him.
Learned counsel appearing on behalf of the petitioner submits that the prosecution case against the
Patna High Court Cr.Misc. No.42470 of 2014 (2) dt.16-04-2015 2/2 petitioner is out and out false. The petitioner was working as Assistant Switch Worker on contract basis and because of certain internal dispute; the petitioner has been implicated in this case.
Keeping in view the nature of allegation, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Electricity) Magadh Area, Gaya, in connection with Akbarpur P.S. Case No. 207 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
