The petitioner has preferred this application for grant of regular bail in connection with Shikarpur PS FIR No 239 of 2023 dated 01.04.2023 registered for the offence punishable under Sections 386, 387, 120B of the IPC.

As per the prosecution case, some unknown person demanded Rs 20 lacs as extortion from the informant. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner bears seven criminal antecedents, as stated in paragraph 3 of the bail petition in which he is on bail. It is

Patna High Court CR. MISC. No.42991 of 2023(2) dt.21-07-2023 2/2 further submitted that the name of the petitioner surfaced in the confessional statement of the co-accused. The petitioner is in custody in this case since 04.04.2023.

Learned APP has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of CJM, West Champaran at Bettiah in Shikarpur PS FIR No 239 of 2023 dated 01.04.2023 subject to the following condition:

The petitioner shall remain physically present before the Court below on each and every date, failing which on two consecutive dates without reasonable cause, his bail bonds are liable to be cancelled.

This application stands allowed.
