====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-08-2018 Heard learned counsels for the petitioner and the State.

Petitioner had earlier moved this Court twice for grant of bail in Cr. Misc. Nos. 53353 of 2016 and 48751 of 2017, which were rejected vide orders dated 14.02.2017 and 06.12.2017 (Annexure-1 series) respectively. In the order dated 06.12.2017 direction was given to the trial Court to conclude the trial within three months and in case the same is not concluded within the aforesaid time, the petitioner may renew his prayer for bail.

Pursuant to the order dated 18.07.2018, a report has been received from the Court below, which is kept at Flag-A. Perusal whereof shows that the trial is in progress and at the advance stage of evidence.

Learned counsel appearing for the petitioner

Patna High Court Cr.Misc. No.36883 of 2018(4) dt.08-08-2018 2/2 submits that inspite of the direction of this Court the trial of the case has not been concluded as yet and as such the petitioner has renewed his prayer for bail. Petitioner is languishing in custody since 12.04.2016.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-II, Sitamarhi in connection with Sessions Trial No. 517 of 2016 arising out of Sonbarsa P.S. Case No. 58 of 2016.
