JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under sections 354 of the Indian Penal Code.

Learned counsel for the petitioner submits that for the occurrence alleged to have taken place on 13.03.2014, the first information report came to be instituted on 08.04.2014 and there is no explanation for such delay. He further submits that institution of present Mahila PS case No. 15/2014 is counter blast of an earlier case instituted by the father of petitioner be Sarai PS case No. 49/2014 in which the husband of informant is an accused. Upon perusal of the allegation, as contained in the first

Patna High Court Cr.Misc. No.42656 of 2014 (2) dt.16-04-2015 2/2 information report, and in view of submission made on behalf of the petitioner, as noted above, I am inclined to grant the petitioner the privilege of anticipatory bail.

Let, the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today be released on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Vaishali at Hajipur in Mahila PS case No. 15/2014, subject to conditions as laid down u/s 438(2) of the Code of Criminal Procedure.
