The petitioner seeks bail in Saharsa Sadar P.S. Case No. 485 of 2016 registered under Sections 395, 307 and 324 of the Indian Penal Code.
The informant alleged that while he along with others was returning the house, five accused persons intercepted them and looted articles from their possession at the point of knife and country made pistol, but in the meantime, the police vehicle came there and caught four persons namely, Manish Kumar, Ajay Kumar, Munna Kumar and Raju Kumar @ Raja Kumar, the petitioner herein, and from their possession, looted articles were recovered.
The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.43683 of 2016 (3) dt.15-12-2016 2/2 nobody was injured, but it appears that the informant got one sharp cutting injury and another caused, was hard and blunt object.
Considering the fact that the petitioner was apprehended on the spot while committing dacoity on road, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner stands rejected.
