1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Learned counsel for the petitioners after arguing vehemently for sometimes seeks permission to withdraw the present anticipatory bail application but submits that petitioner has been falsely implicated in the present case, he is a person with clean antecedent and there is an admitted land dispute between the parties and allegation is not of rape but of attempt.

3. Permission is accorded.

4. However, in the event, if the petitioner surrenders in the learned trial court, the learned trial court without being prejudiced by the orders of this Court shall dispose of the case on its own merit keeping in mind the fact that it is not a case of rape but of attempt and petitioner is a person with clean
