2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 149, 447, 341 , 323 , 307, 354(b), 379 and 504 of the Indian Penal
Patna High Court CR. MISC. No.43032 of 2024(2) dt.23-07-2024 2/3 Code .
3 . As per F.I.R., petitioner No. 1 assaulted nephew of informant by means of sword, petitioner No. 2 assaulted one Parvej Alam with iron rod, petitioner No. 4 assaulted one Chand Mohammad by means of lathi due to which they sustained injuries. It is further alleged that they also snatched cash and committed theft.
4. It is submitted on behalf of the petitioners that both the parties are agnates and due to dispute over pathway , an altercation took place between them in which both sides sustained injuries. Case and counter case . Rest of the allegation are ornamental in nature .
5. Learned counsel for the State oppose the bail petition.
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , East Champaran , Motihari in connection with Sugauli P.S. Case No. 221 of 2023 , subject to the conditions laid down under section 438(2) of the
Patna High Court CR. MISC. No.43032 of 2024(2) dt.23-07-2024 3/3 Code of Criminal Procedure .
