JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 05-08-2015 The petitioner has renewed his prayer for grant of bail in anticipation of arrest in relation to Kanti P.S. Case No. 387 of 2011 pending before Sub-Divisional Judicial Magistrate, West Muzaffarpur.
Prayer of the petitioner was earlier rejected by this Court vide order dated 08.06.2015 passed in Cr. Misc. No. 14725/2015.
Mr. S.B.K. Mangalam, learned counsel appearing on behalf of the petitioner submits that the entire alleged fraudulent payment to the Cooperative has already been deposited to the Cooperative in a surcharge proceedings. Though,
Patna High Court Cr.Misc. No.29091 of 2015 (2) dt.05-08-2015 under protest, it would now be a fit case to reconsider the matter.
I regret my inability to accede to the request. However, if the trial court is satisfied regarding payment, then on surrender of the petitioner before the trial court, the trial court, considering the aforesaid payment, would consider granting bail to the petitioner on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, West Muzaffarpur, in connection with Kanti P.S. Case No. 387 of 2011.
