The petitioner seeks bail in a case instituted under Sections 385 and 387 of the Indian Penal Code. Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application, taking into account that there is specific allegation against the petitioner in respect to demand of ransom by the informant's side. It is second attempt made on behalf of the petitioner for grant of bail. The prosecution case, in brief, is that the informant received a call on his mobile from unknown, demanding a sum of Rs. 5, 00,000/- as ransom, failing which, he would be killed. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.03.2016 and he has got no criminal antecedent.
A report was called for from the Trial Court
Patna High Court Cr.Misc. No.52009 of 2016 (3) dt.25-01-2017 regarding the stage of the case. It has been reported that out of ten prosecution witnesses, two prosecution witnesses have already been examined and the trial is expected to be concluded within a period of five months.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in Tr. No. 3266 of 2016, arising out of Sahebganj P.S. Case No. 41 of 2016, pending in the Court of Sri Manish Pandey, Judicial Magistrate 1st Class, Muzaffarpur.
The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of the order. The District Magistrate, Muzaffarpur and the Senior Superintendent of Police, Muzaffarpur are directed to ensure that the remaining prosecution witnesses are produced in the court on the date fixed by the court below, so that the trial could be concluded within the stipulated period, as indicated by the court below.
Let a copy of this order be communicated to the District Magistrate, Muzaffarpur and the Senior Superintendent of Police, Muzaffarpur.
