The petitioner is accused in connection with Palasi P.S. Case No. 14 of 2017 registered under Sections 341, 323, 354B, 307, 379, 504/34 of the Indian Penal Code. The accusation is that the petitioner and nine other accused persons came at the field of the informant and started to damage his wheat crops. When the informant raised protest then this petitioner with intention to kill him after folding the rope in his neck started to pull. At that time, Shivanand Mandal through lathi caused injury at the head of the informant. When wife of the informant came there to save her husband then co-accused Chandreshwar Mandal gave knife blow to her causing injury in her right hand and in that course, golden ear ring of the wife of the

Patna High Court Cr.Misc. No.23172 of 2017 (2) dt.18-05-2017 2/2 informant was snatched and co-accused Suresh took away Rs.2,000/- from the pocket of the informant.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to previous land dispute while allegation has been made against the petitioner to have folded the rope in the neck of the informant and started pulling causing injury at his head. It is further submitted that the injuries received by the informant are simple in nature. The petitioner having no criminal antecedent, is in custody since 16.03.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Palasi P.S. Case No. 14 of 2017, subject to the condition that out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Mahesh/- U T
