The petitioner seeks bail in Khagaria P.S. Case No. 222 of 2019, instituted for the offence under Section(s) 419, 420, 467, 468, 120(B) of the Indian Penal Code, Sections 27(a), 27(b)(ii), 27(c), 28 and 28(A) of Drug and Cosmetic Act. It is alleged in the written report that informant who was Drug Inspector during course of raid found the petitioner and co-accused Abhimanyu Kumar Raj carrying spurious and adulterated drug in Alto Car bearing registration No. B.R.1AB6009. It is further alleged that on demand, they did not produce any document relating to Drugs being carried by them. They confessed that they prepared the Drugs but did not produce licence of manufacturing the said drugs.

He further submits that owner of the drugs namely Abhimanytu Kumar Raj who was found sitting in Alto car has already been granted bail by coordinate Bench of this Court vide order dated 20.6.2019 passed in Cr. Misc. 37479 of 2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case No. 222 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
