The petitioners seek bail in a case instituted under Sections 395, 412 of the Indian Penal Code and 25(1-b)a, 27 Arms Act.
The prosecution case, in brief, is that on 16.06.2016 at 12.51 P.M., eight unknown persons having armed with weapons criminally trespassed into the jewellery shop of the informant, after pushing his workers and looted golden and silver ornaments and cash of Rs. 3, 50, 000/- from his shop and fled away on motorcycle.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 12.09.2016. The charge sheet
Patna High Court Cr.Misc. No.50324 of 2016 (2) dt.21-11-2016 2/2 has been submitted in the present case. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are not named in the First Information Report. Their names have come in the confessional statement of co-accused. It is alleged that the petitioners have purchased the looted articles from the coaccused. The petitioners have no knowledge that the articles purchased were looted articles.
On behalf of the state, it has been submitted that the petitioners are not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar, in connection with Katihar Town P.S. Case No. 391 of 2016.
