2. The petitioners apprehend their arrest in connection with Maner P.S. Case No.705 of 2022 registered for the offences punishable under Sections 341, 323, 379, 307 and 504 and 506/34 of the Indian Penal Code.

On account of objection raised by the informant regarding throwing of waste water into her house, the petitioners along with other named accused persons, variously armed, came there and started abusing and assaulting the informant. It is specifically alleged that petitioner no.1 assaulted the informant

No.39094 of 2026(2) dt.17-06-2026 2/3 by means of a spade due to which she sustained a cut injury on her palm whereas petitioner no.2 assaulted the informant by means of lathi due to which she received a swollen injury over her head. There is also allegation of snatching of valuables.

The learned Advocate for the petitioners, taking this Court through the FIR, primarily contended that the informant is none else but the wife of the full brother of the father of the petitioners, and only on account of a trivial dispute, an altercation took place between the parties, which resulted into some unfortunate injuries. From perusal of the impugned order, it appears that despite requisition made by the Investigating Officer, the injury report has not been furnished. In the absence thereof, the injuries alleged to have been sustained by the informant prima facie appear to be simple in nature. Moreover, the petitioners are men of fair antecedent and they undertake that they will fully cooperate in the proceedings of the Court. It is lastly contended that, be that as it may, now the parties have amicably resolved their disputes and entered into a compromise, and therefore, they do not wish to pursue the matter any further.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that specific allegation has been leveled against these two petitioners

Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the genesis of the occurrence, coupled with the simple nature of the injury, besides the fact that the parties are close relatives and have decided not to pursue the matter any further, besides the fair antecedent of the petitioners, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Danapur, Patna in connection with Maner P.S. Case No.705 of 2022, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioners.
