Petitioner already in custody in connection with Khaira P.S. Case No.117 of 2013 is an accused in a case registered under Section 364(A) of the Indian Penal Code. First Information Report is against unknown.

Allegation is that the informant's son was kidnapped by 3-4 unknown persons by taking him from the house of his maternal uncle.

It is submitted that the First Information Report is against unknown. Except the name disclosed by one co-accused Mahesh Rabidas, there is no material against the petitioner. Though the petitioner was put on Test Identification Parade but he was not identified by the victim and the victim boy in his

Patna High Court Cr.Misc. No.48931 of 2016 (4) dt.08-03-2017 2 / 2 statement under Section 164 Cr.P.C. has also not named this petitioner rather has named some other persons and this petitioner has been in custody since 04.05.2016.

Having considered the said facts and circumstances, let the petitioner, namely, Prakash Rajak be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No.117 of 2013.
