1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 379, 447, 504/ 34 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he saw petitioner committing theft of the motorcycle of his son on 07.12.2022.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that the petitioner and the informant are neighbour and on account of dispute, a false allegation came to be alleged, when it is not the case of the informant that the
Patna High Court CR. MISC. No.41196 of 2023(2) dt.04-08-2023 2/2 motorcycle was recovered from the possession of the petitioner nor theft of the motorcycle was committed, only an attempt is alleged to have been committed.
5. Learned A.P.P. opposes the bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in connection with Pakaridayal P. S. Case No.304 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
