The petitioner apprehends his arrest in connection with Chanpatia P.S. Case No. 17 of 2024 registered for the offences punishable under Sections 386 & 387 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case in a nutshell is that some unknown person has demanded ransom to the tune of Rs. 15 Lakhs from the informant and in case of non-fulfillment of the same, he threatened to face dire consequences. It is alleged that on 12-01-2024, firing was made at the shop of the informant by one Shivam Pandey.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.42748 of 2024(3) dt.02-08-2024 2/3 petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. Petitioner is not named in the FIR. On the basis of confessionsal statement of co-accused, Laddu Kumar, he has been dragged in this case. Nothing incriminating has been recovered from possession of the petitioner. No specific allegation has been attributed to the petitioner, rather specific allegation is against one Shivam Pandey.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is submitted by referring to paragraph No. 29 of the case diary that sister and mother of the accused Shivam Pandey have identified the voice of the petitioner, which shows his complicity in the present case. It is submitted that charge sheet has been submitted against other co-accused whereas investigation is still pending against the petitioner herein. 6.

Considering the rival submissions made by the learned counsel for the parties, there being involvement of the petitioner in this case, which fact finds mention in paragraph No. 29 of the case diary, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer is rejected. 7.

However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.42748 of 2024(3) dt.02-08-2024 3/3 court below within a period of four weeks from today and prays for regular bail, the same would be considered by the court below in accordance with law without being prejudiced by the order of this Court.
