JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-02-2016 The petitioner is informant of Minapur P.S. Case No.61 of 2013 under sections 420, 406 and 504 of the Indian Penal Code. By way of the present application under Articles 226 and 227 of the Constitution of India, he seeks a direction to be issued to the respondents to conclude the investigation of the aforesaid police case and submit charge-sheet against the accused persons named in the FIR within three months.

At the outset, it has been submitted by the learned counsel for the State that during the pendency of the application the police have completed the investigation and submitted final report under section 173(2) of the Code of Criminal Procedure holding the case to be of civil nature.

In that view of the matter, learned counsel for the

Patna High Court Cr. WJC No.701 of 2015 (2) dt.04-02-2016 2/2 petitioner seeks leave to withdraw the present application in order to raise his grievance before the jurisdictional Magistrate. Leave is granted.
