JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Banmankhi P.S. Case No. 46 of 2017 registered under Sections 272, 273 of the Indian Penal Code and 30(A) of the Bihar Excise Act, 2016.

The accusation is of recovery of a gallon from the possession of the petitioner, containing five litres country-made liquor.

Learned counsel for the petitioner submits the petitioner having no criminal antecedent, is in custody since 10.03.2017.

Having regard to the facts and the circumstances

Patna High Court Cr.Misc. No.23211 of 2017 (2) dt.18-05-2017 2/2 of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Purnea (Excise Act) vide Special Case No. 253 of 2017 in connection with Banmankhi P.S. Case No. 46 of 2017, subject to the condition that out of two sureties, one surety must be the close relative of the petitioner.
