Petitioner has earlier moved this Court for grant of bail in Cr. Misc. No. 30648 of 2020, which was rejected vide order dated 09.02.2021, as contained in Annexure-1. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Petitioner is in custody custody since 27.10.2019 i.e. for two years.

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that earlier the prayer for bail of the petitioner was rejected on merit and there no fresh ground urged on behalf of the petitioner.

Patna High Court CR. MISC. No.50329 of 2021(3) dt.27-10-2021 2/2 Earlier, by order dated 08.09.2021 a report was called for from the court below, which has been received and kept at Flag-'X'. Perusal of the report shows that the case has not yet been committed to the court of sessions due to nonservice of police paper on another accused. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court is not inclined to grant bail to the petitioner. His prayer for bail is, accordingly, rejected.
