Petitioners are in custody in connection with Dhansoi P.S. Case No. 113 of 2015 registered under Sections 147, 148, 149, 341, 323, 307, 504 and 302 of the Indian Penal Code. Learned counsel for the petitioners has submitted that the petitioners are co-villagers of the informant and he has implicated in this case due to village politics. In fact, there is a land dispute between the parties. Though there is allegation of sword blow on the person of the deceased, but there is no injury which shows that the same has been caused by sharp cutting weapon rather the injury report states that the injury caused by the hard and blunt substance. The petitioner are languishing in custody for the last five months.

Patna High Court Cr.Misc. No.47455 of 2016 (5) dt.06-03-2017 Learned A.P.P. for the State submitted that there is specific allegation against these petitioners and vehemently opposed the prayer for bail by stating that petitioners have already lots of criminal history.

Considering the facts and circumstances of the case and nature of accusation, this Court is not inclined to grant bail to these petitioners. Accordingly, the prayer for bail of these petitioners is rejected.
